Overview

Welcome to MikeAndMatt.co.uk. In these terms, "we", "us" and "our" mean MikeAndMatt.co.uk, run by Matt Morton, a sole trader. "You" means the person using our website or buying from us.

These Terms of Service ("Terms") apply when you use our website, mikeandmatt.co.uk, and when you buy products from us (together, the "Services"). They should be read with our Privacy Policy, Refund Policy and Shipping Policy, which form part of these Terms.

Please read these Terms before placing an order. By using our website or placing an order, you agree to them. If you do not agree, please do not use the Services.

Your legal rights. If you are buying as a consumer, nothing in these Terms affects your legal rights under the Consumer Rights Act 2015, the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 or any other UK consumer law. Where anything in these Terms conflicts with those rights, your legal rights apply.

2. Using our website and your account

You must be at least 18 years old to place an order. If you are under 18, please ask a parent or guardian to place the order for you.

When you place an order or create an account, please make sure the information you give us (such as your name, email address, delivery address and payment details) is correct and up to date.

If you create an account, you are responsible for keeping your login details secure. Please tell us straight away if you think someone else has used your account.

3. Our products

Our products are made from MDF, a manufactured wood product. We work hard to make sure our descriptions, sizes and photos are accurate. However, small differences in colour, surface finish and edge detail can occur between batches. Colours may also look slightly different depending on your screen.

All sizes are given as accurately as we can. Small tolerances are normal when cutting and machining MDF.

Our products are sold as unfinished blanks for craft, display and similar uses. They are not toys and are not intended for use by young children without adult supervision.

We may change our product range, descriptions or prices from time to time. This will not affect orders we have already accepted.

4. Custom and made-to-order items

We are happy to cut custom sizes and shapes. For custom orders, we will confirm the specification, price and expected dispatch time with you before we start.

Please check your custom specification carefully. Because custom-cut items are made to your specification, they cannot be returned for a change of mind and the 14-day cancellation right does not apply to them. This does not affect your rights if a custom item is faulty, damaged, or not made to the specification we agreed. See our Refund Policy for details.

5. Orders

When you place an order, you are making an offer to buy. After you order, we will send you an email confirming we have received it. Our acceptance of your order, and the contract between us, takes place when we email you to confirm your order has been dispatched (or, for custom items, when we confirm the custom order with you).

We may decline an order, for example if an item is unavailable, if there is an obvious error in the price or description, or if we cannot deliver to your address. If we decline or need to change your order, we will contact you using the details you gave us and refund anything you have paid for items we cannot supply.

Business customers, makers and crafters are welcome to buy from us, including to make items for resale.

6. Prices and payment

All prices are in pounds sterling (GBP). We are not VAT registered, so no VAT is added to our prices.

Delivery charges are shown in your basket and at checkout before you pay. See our Shipping Policy for current delivery charges.

The price you pay is the price shown when you place your order. If we have made an obvious pricing mistake, we will contact you before dispatch. You can then choose to go ahead at the correct price or cancel for a full refund.

Payments are processed securely by Shopify and its payment partners. We never see or store your full card details. Promotions and discount codes may have their own terms, which we will make clear at the time.

7. Delivery

We deliver to addresses in the United Kingdom only. Delivery times, couriers and charges are set out in our Shipping Policy.

Delivery times are estimates. We will always deliver your order within 30 days unless we have agreed a different date with you. If we cannot, we will contact you and you may cancel for a full refund.

If you are a consumer, the items are our responsibility until they are delivered to you or to someone you have nominated to receive them. Ownership of the items passes to you once we have received full payment.

8. Cancellations, returns and refunds

Your right to cancel, our 30-day returns promise, and what to do if an item arrives damaged or faulty are explained in our Refund Policy.

9. Intellectual property

The text, photos, logos, graphics and design on this website belong to MikeAndMatt.co.uk or are used with permission. They are protected by copyright and other intellectual property laws.

You may view and print pages for your own personal use. You must not copy, reproduce or reuse our content for commercial purposes without our written permission.

Shopify's name and logo are trademarks of Shopify. Other names and logos on the website belong to their respective owners.

10. Third-party tools and links

Our website may include tools or links provided by third parties. We do not control these and are not responsible for their content, availability or policies. Please check their terms before using them.

11. Relationship with Shopify

MikeAndMatt.co.uk is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our store are made directly with MikeAndMatt.co.uk. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and MikeAndMatt.co.uk, including any injury, damage, or loss resulting from purchased products and services. You hereby expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with MikeAndMatt.co.uk.

12. Privacy

We collect and use your personal information as described in our Privacy Policy. Because our store is hosted by Shopify, some personal information is also processed by Shopify, as described in Shopify's Privacy Policy.

13. Reviews and feedback

If you send us a review, photo, suggestion or other feedback, you allow us to use it free of charge to run and promote our business, for example by showing your review on our website. Please make sure anything you send is honest, lawful and your own. We may remove or decline to publish content that is offensive, misleading or unlawful.

14. Acceptable use

Please use our website lawfully. You must not:

  • use the website for any unlawful, fraudulent or harmful purpose;
  • introduce viruses or other harmful code, or try to gain unauthorised access to the website or its systems;
  • copy, scrape or extract content or data from the website using automated tools without our permission;
  • harass, abuse or threaten us or anyone else; or
  • pretend to be someone else or give false information.

We may suspend or close an account that breaks these rules.

15. Automated agents

15.1 This section applies if you use, allow or cause an Agent to access or interact with the Services. "Agent" means any software or service that takes autonomous or semi-autonomous action on behalf of, or at the instruction of, any person or business without direct supervision.

15.2 No Agent may access or interact with the Services unless it identifies itself and operates in line with section 15.4 at all times. No Agent may access the Services if we have asked it not to.

15.3 We may limit, including by technical measures, whether and how any Agent accesses or interacts with the Services.

15.4 Agents must: (i) identify themselves in all HTTP/HTTPS requests by including "Agent/[agent name]" in the user agent string; (ii) not hide that they are an Agent, for example by mimicking human behaviour or getting around CAPTCHAs or similar checks; (iii) answer truthfully if asked whether they are a human or a computer; and (iv) not get around any measure intended to block, limit or control Agent access.

16. Our responsibility to you

If you are a consumer, we must supply products that are of satisfactory quality, fit for purpose and as described. If we do not, you have legal remedies, which are explained in our Refund Policy.

We are responsible for loss or damage you suffer that is a foreseeable result of us breaking these Terms or failing to use reasonable care and skill. We are not responsible for loss or damage that is not foreseeable.

We do not exclude or limit our liability where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, and for breach of your legal rights as a consumer.

If you are a consumer, we only supply products for domestic and private use. If you use the products for commercial or business purposes, we are not liable to you for any loss of profit, loss of business, business interruption or loss of business opportunity.

If you are buying as a business, our total liability to you for any order is limited to the price you paid for that order, except where the law does not allow this.

Please follow any product guidance we give. For example, when cutting, sanding or drilling MDF, use suitable dust protection and ventilation. We are not responsible for loss or damage caused by misuse of the products or by changes you make to them.

We aim to keep the website available and accurate, but we cannot promise it will always be uninterrupted or error-free.

17. Events outside our control

We are not responsible for delays or failure to perform caused by events outside our reasonable control, such as severe weather, courier or postal disruption, strikes, or supplier failures. If this happens, we will let you know as soon as we can and take steps to reduce the delay. If there is a significant delay, you may cancel and receive a refund for anything you have paid for items not yet received.

18. Errors on the website

Occasionally our website may contain mistakes in product descriptions, prices, delivery charges or availability. We may correct errors at any time. If a mistake affects an order you have placed, we will contact you before dispatch so you can choose whether to go ahead or cancel for a full refund.

19. Other important terms

Transfer. We may transfer our rights and obligations under these Terms to another business. If we do, we will tell you and make sure the transfer does not reduce your rights. You may only transfer your rights or obligations with our written agreement.

Severability. If a court decides that any part of these Terms is unlawful or unenforceable, the rest of the Terms will still apply.

No waiver. If we delay or do not enforce any of these Terms, we can still enforce them later.

Whole agreement. These Terms, together with the policies linked above and your order confirmation, are the whole agreement between you and us about your purchase.

Third parties. Nobody else has any rights under these Terms, except Shopify as set out in section 11.

20. Changes to these Terms

We may update these Terms from time to time, for example to reflect changes in the law or how we run our business. The version on this page when you place your order will apply to that order. The "Last updated" date at the top shows when the Terms were last changed.

21. Governing law and disputes

These Terms are governed by the laws of England and Wales. If you are a consumer, you may bring legal proceedings in the courts of England and Wales. If you live in Scotland, you may also bring proceedings in the Scottish courts. If you live in Northern Ireland, you may also bring proceedings in the Northern Irish courts.
